Welcome to SmartQal! These Terms of Service govern your access to and use of our platform, website, services, and features (“Services”). By using SmartQal, you agree to be bound by these Terms.
SmartQal is a service provided by Qodexcore Technologies, responsible for operating this platform and enforcing these Terms of Service.
1. Acceptance of Terms
By accessing or using SmartQal, you confirm that you have read, understood, and agree to these Terms of Service. If you do not agree, you may not use our Services.
2. Services Provided
SmartQal offers an online booking, scheduling and service‑management platform for businesses offering appointments (with or without video‑calls), rentals, and hospitality services, and service providers in general. Features may include: service creation with custom fields and image uploads; public booking links; payment processing (via Paystack); calendar integration (via Google); WhatsApp Business Cloud API notifications; analytics; and more.
3. User Accounts
- To access certain features, you must create an account.
- You must provide accurate, complete and current information during registration.
- You are responsible for safeguarding your login credentials and all activities under your account.
- You agree to notify us immediately of any unauthorized account usage.
4. Payment & Subscription Plans
Main features require a paid subscription. Payments are securely processed via supported gateways such as Paystack and Hubtel. Subscription plans may be billed monthly or annually. Any refunds are subject to SmartQal’s refund policy.
5. Bookings & Service Rules
- You must ensure your service listings, availability, pricing and policies are accurate.
- SmartQal may suspend or remove accounts violating these Terms.
- SmartQal is not responsible for disputes between service providers and customers.
6. WhatsApp Business Cloud API Notifications & Consent
SmartQal uses the WhatsApp Business Cloud API to send utility and transactional messages such as booking confirmations, reminders, updates, receipts and service notifications.
By entering your phone number and completing a booking, reservation, rental, or appointment on SmartQal, you explicitly consent to receive these transactional messages related to your activity on the platform.
These messages are service-related and not promotional advertising. You may opt-out of WhatsApp notifications at any time via your account settings or by contacting support. Opting out may affect your ability to receive important updates about your bookings.
7. User Conduct
You agree NOT to:
- Use the Services for unlawful, fraudulent or malicious purposes.
- Upload harmful, offensive or illegal content.
- Attempt to disrupt, hack, or gain unauthorized access to SmartQal or other user accounts.
- Harass, abuse or harm any user of the platform.
8. Data & Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use and protect your data.
9. Limitation of Liability
SmartQal is not responsible for losses resulting from cancelled bookings, no‑shows, rental disputes, or unauthorized access caused by your failure to secure your account. To the fullest extent permitted by law, SmartQal is not liable for any indirect, incidental, special or consequential damages arising from your use of the Services.
10. Modifications to Terms
SmartQal may update these Terms at any time. The updated “Last Updated” date will appear at the top of this page. Continued use after changes indicates acceptance.
11. Governing Law
These Terms shall be governed by the laws of Ghana. Any disputes will be handled under the jurisdiction of Ghanaian courts.
